These Terms of Service (“Terms”) govern your use of the website at neuryx.ai and any services provided by Neuryx AI, LLC (“Neuryx,” “we,” “us,” or “our”). By accessing or using the site, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old to use this site, submit our contact form, or opt in to SMS communications. By using the site, you represent that you meet this age requirement.

2. Use of the Site

You may use the site for lawful purposes only. You agree not to:

• Use the site in any way that violates applicable law or regulation
• Attempt to gain unauthorized access to any part of the site, our infrastructure, or other users’ information
• Interfere with or disrupt the site’s operation, including the voice agent demo or contact form
• Use automated systems (bots, scrapers) to access the site except as permitted by our robots.txt
• Submit false, misleading, or fraudulent information through any form on the site

AI, Automation, Voice, Messaging, and Demo Features

Any AI, automation, voice, messaging, workflow, demo, or similar feature made available by Neuryx is provided for general informational, operational, evaluation, demonstration, or business purposes only.

Outputs generated by AI, automation, voice, messaging, workflow, demo, or similar features may be incomplete, inaccurate, delayed, unavailable, or unsuitable for a particular purpose. You are responsible for reviewing and independently evaluating any output before relying on it.

No output, communication, demo interaction, website content, or automated response constitutes legal, financial, medical, professional, technical, business, or other advice, and no such output or communication creates a binding commitment, representation, warranty, offer, agreement, or obligation by Neuryx unless expressly set forth in a separate written agreement signed or otherwise authorized by Neuryx.

We may monitor, record, transcribe, summarize, analyze, retain, use, disclose, or otherwise process interactions with AI, automation, voice, messaging, workflow, demo, or similar features as described in our Privacy Policy or as otherwise permitted by law.

Demonstration, evaluation, sample, or showcase features made available through our website or communications channels are provided for illustrative purposes only. Demonstration features may be modified, limited, throttled, suspended, or discontinued at any time. Demonstration features should not be used to transmit sensitive, confidential, regulated, proprietary, or personally identifiable information beyond what is reasonably necessary for the demonstration.

Where Neuryx designs, configures, deploys, hosts, operates, integrates, or supports AI agents, voice systems, SMS or messaging systems, automation workflows, dashboards, or related tools on behalf of a business customer, the business customer is generally responsible for the lawful and appropriate use of the resulting systems with respect to its own customers, contacts, callers, message recipients, and end users, including, without limitation, the provision of any required notices, consents, disclosures, policies, and recording or communication notices. Neuryx makes no representation or warranty regarding the legal sufficiency of any such notices, consents, or disclosures, and the business customer is solely responsible for obtaining appropriate legal, regulatory, and professional advice.

Communications and SMS

If you provide contact information to Neuryx, we may use it to communicate with you regarding inquiries, meetings, projects, services, updates, transactions, business matters, or other matters related to Neuryx, including, without limitation, by email, phone, SMS, messaging platforms, automated systems, voice agents, automated assistants, or other communication methods.

SMS or similar messaging sent by or on behalf of Neuryx is generally sent through registered, verified, or otherwise approved messaging campaigns, brands, numbers, and providers maintained in accordance with applicable carrier, registry, aggregator, and provider requirements, including, without limitation, toll-free verification, A2P 10DLC registration where applicable, and other messaging compliance requirements. Such messaging is intended to be primarily transactional and relationship-based.

Message frequency may vary. Message and data rates may apply. Delivery is not guaranteed and may depend on third-party providers, carriers, networks, devices, and other factors outside our control. Consent to receive SMS or similar messaging may be subject to additional disclosures, consent language, platform requirements, provider requirements, carrier requirements, or applicable law. We may suspend, modify, limit, register, re-register, restrict, or discontinue messaging at any time. We may also be required by carriers, registry providers, or applicable law to suspend, restrict, or terminate messaging.

Where you receive SMS or other messaging from a Neuryx-built system that is operated by a business customer of Neuryx rather than by Neuryx directly, your interaction with that messaging is generally governed by the policies, terms, and practices of that business customer, and any inquiries, opt-outs, or requests should be directed accordingly.

5. Intellectual Property

The site, including all content, design, code, branding, and the Neuryx name and logo, is owned by or licensed to Neuryx AI, LLC and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the site without our written permission.

6. Third-Party Services

Our site uses third-party services (Vercel, Resend, ElevenLabs, Cloudflare, n8n, Twilio, Vercel Analytics) as described in our Privacy Policy. These services have their own terms and we are not responsible for their practices, though we select providers with appropriate security and privacy commitments.

Services Provided to Business Customers

Certain services, deliverables, or systems provided by Neuryx are designed, configured, deployed, integrated, or supported on behalf of business customers and are operated by or for those business customers in connection with their own businesses, customers, contacts, callers, message recipients, and end users.

Where you interact with a Neuryx-built system operated by a business customer, including, without limitation, an AI voice agent, SMS or messaging system, chat agent, automation workflow, or related tool, your interaction is generally governed by the policies, terms, notices, and practices of that business customer. Neuryx is not responsible for the acts, omissions, communications, decisions, configurations, content, notices, consents, or compliance practices of any business customer or their personnel.

Business customers are solely responsible for the lawful and appropriate operation of Neuryx-built systems with respect to their own customers and end users, including, without limitation, the provision of any required notices, consents, disclosures, opt-out mechanisms, recording notices, and policies.

7. Disclaimers

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION. Information presented on the site is for informational purposes and does not constitute a binding offer or contract until reduced to a separate written agreement.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEURYX AI, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

9. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict of laws principles. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in Ontario County, New York.

10. Changes to These Terms

We may update these Terms from time to time. The “Effective Date” at the top reflects the most recent revision. Continued use of the site after changes constitutes acceptance of the updated Terms.
